Implementing Legislation
At the time of writing, no specific domestic legislation implementing the Singapore Convention on Mediation in Mauritius has been identified.
Mauritius's existing mediation framework predates the Convention, and it has not been confirmed whether, or how, that framework extends to the recognition and enforcement of international settlement agreements falling within the scope of the Convention.
Procedure for Enforcing International Mediated Settlement Agreements
Mauritius ratified the Singapore Convention on Mediation on 17 August 2026. In accordance with Article 14(2) of the Convention, it will enter into force for Mauritius on 17 February 2027.
At the time of writing, no specific domestic procedure for the enforcement of international mediated settlement agreements under the Singapore Convention on Mediation has been identified.
Mediation Legislation
Judicial mediation before the Supreme Court of Mauritius is principally governed by Section 17A of the Courts Act (Act 41 of 1945) and the Supreme Court (Mediation) Rules 2010.
Section 17A of the Courts Act empowers the Supreme Court to conduct mediation in civil proceedings. The Chief Justice may refer a civil matter to a Judge for mediation with a view to resolving the dispute by agreement or narrowing the issues between the parties.
The Supreme Court (Mediation) Rules 2010 apply to civil matters pending before the Supreme Court. A party may apply to the Chief Justice for a matter to be referred to mediation. Where the parties reach an agreement, the mediation Judge records the terms of the settlement. This framework concerns court-connected mediation.
The Employment Relations Act 2008 provides for the conciliation and mediation of labour disputes through a statutory Commission.
At the time of writing, no general statutory framework governing private commercial mediation and the enforcement of settlements resulting from such mediation has been identified.
